Spartan Financial Solutions

These Terms of Service ("Terms") govern your use of the Spartan Financial Solutions platform ("Service"), provided by Spartan Financial Solutions LLC ("we," "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

The Service is for licensed insurance agencies and their employed or contracted agents. By signing up you represent that the agency is properly licensed in every state in which it operates and that you are authorized to bind it to these Terms.

2. Subscription & payment

Plans, pricing, and feature inclusions are described at sign-up. Monthly subscriptions auto-renew until canceled. Trials are limited to five (5) days; a card on file is required to start a trial and is charged on day six unless you cancel. Refunds are issued at our discretion for billing errors.

3. Acceptable use

You will not use Spartan Financial Solutions to send messages in violation of the TCPA, CAN-SPAM, state mini-TCPAs, or any other law.
You will obtain express written consent before sending marketing SMS and will honor opt-outs.
You will not upload or transmit content that is unlawful, defamatory, or infringes third-party rights.
You will not attempt to access another agency's data, reverse-engineer the platform, or interfere with its operation.
You will not use the AI tools to impersonate a human if asked directly whether they are speaking with one.

4. Compliance is your responsibility

Spartan Financial Solutions provides tools to help with TCPA, NAIC, and state insurance compliance — including consent capture, quiet-hours enforcement, and AI compliance scanning. These are aids, not legal advice. You are solely responsible for ensuring your communications and sales practices comply with applicable law in every jurisdiction in which you operate.

5. Your data

You retain ownership of all customer and policy data you put into the Service. We process it as a processor on your behalf — see our Privacy Policy. You may export your data at any time. On termination we delete it after the regulatory retention period.

6. Third-party services

Spartan Financial Solutions depends on third parties (Twilio, Vapi, Stripe, Anthropic, and others). You authorize us to share data with them as needed to deliver the Service. Each is bound by a Data Processing Agreement and listed at /subprocessors.

7. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance is communicated in advance. We are not liable for outages caused by sub-processors, your internet connection, or force majeure.

8. Termination

You may cancel any time from the Settings → Billing page. We may suspend or terminate accounts that violate these Terms or are unpaid. After termination you have 30 days to export your data; after that, we retain it only as required by law and then permanently delete it.

9. Limitation of liability

To the maximum extent allowed by law, our aggregate liability for any claim arising out of these Terms or the Service is limited to the amount you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages — including lost profits or business — even if advised of the possibility.

10. Indemnity

You will indemnify Spartan Financial Solutions LLC against any claim arising from your violation of law, your violation of these Terms, or your use of the Service in a way that breaches a third party's rights — including TCPA actions resulting from messages you sent through the platform.

11. Disclaimers

The Service is provided "as is." We make no warranties beyond those that cannot be disclaimed under applicable law.

12. Governing law

These Terms are governed by the laws of the state of Texas, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Travis County, Texas.

13. Changes

We may update these Terms; material changes are emailed to account owners 30 days before they take effect.

14. SMS Messaging Terms

By providing your mobile phone number and opting in — either through the web form at spartan-os.com/sms-opt-in or verbally during a consultation with a licensed Spartan Financial Solutions agent — you agree to receive SMS text messages from that agent. The following terms apply to all SMS communications:

Message types: Life insurance quotes, appointment reminders, policy updates, and responses to your inquiries.
Frequency: Message frequency varies based on your interaction. Typically 2–4 messages per active inquiry.
Costs: Message and data rates may apply depending on your mobile carrier and plan.
Opt-out: Reply STOP at any time to unsubscribe. You will receive one confirmation and no further messages. Reply START to re-subscribe.
Help: Reply HELP for assistance, or contact your agent directly.
Data: Your phone number will not be shared with third parties for marketing purposes. See our Privacy Policy section 10 for full details.
Carriers: Spartan Financial Solutions LLC is not liable for delayed or undelivered messages due to carrier issues.
